Government relaxes regulations on internet-based businesses

The government recently issued a new decree on removing many cumbersome regulations and procedures to ease internet-based businesses, the Ministry of Information and Communications (MIC) announced.
MIC Deputy Minister Hoang Vinh Bao said that Decree 27/2018/ND-CP was approved in accordance with the new situation and eliminates unreasonable requirements in order to support enterprises which provide internet-based services.
Specifically, 10 business conditions and 13 notification procedures have been removed from the list of requirements.
The new decree abolished five conditions for the licensing of content of online video game scripts, three conditions for the operation of websites and social networking platforms, and two notification procedures for the amendment, supplementation, deadline extension and re-granting of licenses for G1 video game services.
The decree also eliminated 11 types of documents required to register the provision of online video games, and two documents for the creation of websites and social networking platforms.
The time for licensing the establishment of an online information website or a social network will be cut from 15 working days to 10 working days.
Decree 27 also amends the regulations on protecting national interests in the registration and use of new generic top-level domains and stipulates the conditions for internet domain registrars in accordance with the reality.
Following the government’s instruction, many ministries have accelerated the removal of cumbersome administrative procedures and business conditions to ease enterprises.
The Ministry of Transport recently announced the elimination of 384 out of 570 business conditions under the ministry’s authority. The number is equivalent to 67.36 percent of the total business conditions in the transport sector.
The aviation sector has the largest number of business conditions to be simplified and cut, accounting for 74.36 percent of the total business conditions of the sector. It is followed by the rail sector with 73.08 percent of its business conditions being cut.
The Ministry of Finance is also considering removing and simplifying 188 business conditions under its authority. The number accounts for 50.8 percent of the total business conditions regulated for 21 industries and sectors under the ministry’s authority.
To meet the target, the ministry proposed to revise five laws and 11 decrees, of which the revision of the decrees will be submitted to the government for approval and issuance according to simplified order and procedures so that the new regulations can be applied before June 30, 2018.
As for the five laws, the ministry suggested that it will report the revision to the government for consideration. Then, the Prime Minister can submit the revision to the National Assembly (NA) to add them in the NA’s legal building plans before June 30 this year.
The Ministry of Agriculture and Rural Development (MARD) said they were also reviewing and proposing to cut 241 business conditions out of 345, accounting for 70 percent of the total in the area.
According to the ministry, 131 conditions of veterinary, animal feed, plant protection and quarantine, quality control, and genetically modified products will be revised, supplemented or eliminated in the administrative simplification. In addition, many business conditions in the Law on Seafood would continue to be revised and simplified.
Assessing the results of these ministerial reforms, Tran Dinh Thien, director of the Vietnam Institute of Economics, said that the reform momentum has been creating high confidence for businesses, with detailed lists of reduction and policy reforms.
However, he noted that ministries must make ‘real cuts’, reiterating the Prime Minister’s opinion that the gap between words, actions and achievements is not easy to overcome.
