Bill on children submitted to the National Assembly

On November 12, Bill on protection, care and education of children (revised) was submitted to the National Assembly.

In particular, the Committee on Culture, Education, Youth, Teens and Children's Parliament agreed to rename Law Children Act as one embodiment of the present Government. The name is short, covering the full scope of the Act and in accordance with the naming of the Act that have been issued in relation to specific target groups such as Law on the Youth, Law on the Elderly, Law on People with disabilities.

Proposition additional new rules to solve problems of practical problems in the implementation of child rights oriented approach that is shifted from demand-driven approach, focus on resolving the core issues and key against children in general, children with special circumstances in particular to build a comprehensive legal framework and approach based on children's rights. At the same time improving the law on ensuring the rights of children, especially on child protection; international integration, harmonization of child rights and the principles of the UN Convention on the Rights of the Child, other related international treaties.

Draft Law consists of 7 chapters and 106 articles, regulates the rights and duties of children; principles and measures to ensure the implementation of children's rights and the responsibility of the State, families and society in the implementation of children's rights "(Article 2). Compared to the 2004 Act, the draft extends the concept of children in both age and scope, namely Article 1 stipulates that "children are the persons under eighteen years old" without limitation as 
Vietnamese citizens under sixteen years old.

Drafting Authority explains, a person under eighteen years old are not fully developed, incomplete physical, intellectual, spiritual and psychological, are not qualified to perform comprehensive rights and obligations of the People should have the guidance, care of the family, the State and society, need to be protected legally and socially, fully developed, are protected from acts harmful to children. Raising children under the age of sixteen and under eighteen years old without 
limitation as Vietnam's citizens to ensure consistency and compatibility of this law with the UN Convention on the Rights of Children, the international conventions and legal system in Vietnam.

This proposal is also the majority opinion in the verification agency agreed and said that this adjustment is necessary, just to ensure compliance with international conventions on children's rights, has agreed with the provisions of Vietnam's law on adulthood, and consistent with the age of completion of secondary education, as education levels help children complete personality development, both physically and mentally, willing to participate in social life.
