Hanoi eyes effective implementation of Capital Law

Efforts should aim at eliminating overlaps and ensuring streamlined, efficient, and effective governance.

Hanoi requires a comprehensive, effective, and synchronized implementation of the Capital Law, closely integrated with the execution of the Hanoi Planning for 2021-2030, with a vision toward 2050, as well as the adjustment of Hanoi's Master Plan until 2045, with a vision toward 2065.

This statement was made by Secretary of the Hanoi Party Committee, Bui Thi Minh Hoai, during the announcement of Directive No. 37 on the implementation of the Capital Law.

The Standing Committee of the Hanoi Party Committee calls upon Party organizations, government bodies, the Vietnam Fatherland Front, and political and social organizations at all levels to give priority to  the following key tasks:

First and foremost, athe directive underscores the importance of disseminating and raising awareness about the content, significance, role, and critical mechanisms, policies, and regulations of the Capital Law. The goal is to enhance understanding among officials, Party members, and citizens and ensure a unified and coordinated approach in applying the Party's guidelines, the State's policies, and laws related to the development and protection of the capital.

Efforts must be focused on mobilizing all resources to expeditiously develop and finalize the documents necessary for implementing the Capital Law within the city’s jurisdiction.  The drafting of these documents has been identified as a top priority on the city's leadership and administrative agenda.

Heads of the relevant agencies are expected to directly oversee the preparation and ensure consistency with the Party’s guidelines, state laws, and the city's practical requirements. The legal framework needs to be reviewed and updated to ensure consistency, transparency, and accessibility, facilitating the effective implementation of the law.

The directive stresses adherence to Politburo Regulation No. 178-QD/TW, dated June 27, 2024, on controlling power, combating corruption, and preventing misconduct in drafting of the Capital Law guiding documents. It also requires compliance with the amended Law on Promulgation of Legal Documents. In drafting implementation documents, emphasis should be placed on addressing Hanoi’s specific needs and incorporating updated central directives on institutional reform and streamlined administrative structures.

On the basis of the approved Capital Plan and Master Plan, the city is tasked with refining a comprehensive system of plans across sectors and levels, emphasizing development models and frameworks defined in the Capital Law. This system will serve as a foundation for translating the law’s policies and mechanisms into actionable plans.

The directive also highlights the need to review and reorganize administrative structures, including the roles and functions of government agencies, to align them with state management objectives. Efforts should be aimed at eliminating overlaps and ensuring streamlined, efficient, and effective governance. Personnel should be allocated appropriately to meet the city's unique workload and responsibilities, and a remuneration policy should be implemented as authorized by the Capital Law.

Additionally, the directive calls for a review of the city's proposals for decentralization and delegation of powers in line with the Capital Law. This should enhance autonomy and accountability, particularly in areas like finance, budget, investment, culture, education, healthcare, urban management, and environmental protection. Mechanisms for monitoring and controlling power must accompany these efforts to ensure effective governance and socio-economic development while maintaining national defense and security.

The Standing Committee assigns the City People’s Council leadership to formulate policies and regulations under its jurisdiction for implementing the Capital Law. It will also oversee the execution of the law, related documents, and directives as set forth in this instruction.
